Defendants, the operators of confined animal feeding operations, were granted interlocutory review of a district court ruling denying their motion for summary judgment on plaintiffs’ negligence and nuisance claims. Defendants contend the district court erred in finding the immunity from nuisance suits provided by Iowa Code section 657.11(2) was unconstitutional under the Inalienable Rights Clause of article I, section 1 of the Iowa Constitution as applied to the present case.
