On appeal from his conviction for murder in the first degree, defendant Keyon Harrison argues: (1) the felony murder rule violates due process when applied to juveniles; (2) the imposition of a life sentence is cruel and unusual when sentencing a juvenile for felony murder; (3) the district court did not properly instruct the jury regarding the types of assault necessary to establish the forcible felony robbery element of felony murder; (4) the felony merger doctrine should apply and trial counsel was ineffective in failing to request that the jury be instructed that it had to find the assault component of the predicate felony of robbery was a separate act from the shooting that caused the victim’s death; (5) trial counsel was ineffective in failing to object certain evidence presented at trial; and 6) the cumulative effect of trial counsel’s errors constitute prejudice.
