Cody Smith seeks further review after the court of appeals affirmed the district court’s denial of his motion to suppress evidence. Smith argues the sparing application of the community caretaking exception may not be expanded to justify seizures absent compelling circumstances necessitating immediate action. He further argues the protections granted under article I, section 8 of the Iowa Constitution should be expanded to limit seizures under the community caretaking exception and to apply the exclusionary rule to evidence obtained after the purpose of the community caretaking exception has been satisfied.
