Case No. 17-1300

Banilla Games, Inc.
v.
Iowa Department of Inspections and Appeals

Banilla Games, Inc. (Banilla), a manufacturer of electronic games devices seeking to distribute its systems in Iowa, appeals the district court’s ruling on its petition for judicial review. The district court affirmed the Department of Inspections and Appeals’ (DIA) decision, finding that Banilla was required to register its devices pursuant to Iowa Code section 99B.53(1). Banilla argues that section 99B.53(1) does not apply to its machines because the outcome of the devices is “primarily determined by skill or knowledge.” Banilla argues the DIA erroneously interpreted chapter 99B and committed an unreasonable or arbitrary abuse of discretion.
