The State appeals from a district court order granting plaintiff employee organization a summary judgment in its action pursuant to Iowa Code section 20.17(5)(2017) to enforce the terms of a collective bargaining agreement. The State contends the district court erred in finding that the parties have a valid and enforceable collective bargaining agreement because: (1) the court did not have subject matter jurisdiction over the dispute; (2) the employee organization failed to exhaust its administrative remedies with the state Public Employment Relations Board (PERB) prior to filing suit; (3) the district court should have deferred the case to PERB under the doctrine of primary jurisdiction; and (4) the district court applied the wrong legal standards in finding the parties had entered into a binding collective bargaining agreement.
