Terrence Gordon appeals his convictions following his guilty plea for assault on a peace officer with a dangerous weapon, two counts of assault on a peace officer, public intoxication, as a third offense, and fifth-degree criminal mischief. After sentencing, the district court delayed mittimus for two days to grant Gordon’s request for a 48-hour furlough. Gordon failed to return from his furlough. An arrest warrant was issued, and his trial counsel filed a notice of appeal. He argues that due to the ineffective assistance of counsel and prosecutorial misconduct, the plea agreement and the plea proceedings were executed on an agreement calling for the State’s performance of a condition that it knew was forbidden by statute (the furlough), and the guilty pleas must be vacated.
