The Iowa Secretary of State has been granted permission for an interlocutory appeal seeking expedited review of a district court ruling which granted plaintiffs’ motion for a temporary injunction. The temporary injunction enjoins enforcement of certain statutory amendments to the absentee voting provisions of Iowa Code chapter 53, enacted in 2017, pending the district court’s resolution of the plaintiffs’ challenge to the constitutionality of those amendments under the Iowa Constitution. The amendments in question: (1) shorten the absentee voting period from 40 days to 29 days before an election; (2) provide for the rejection of absentee ballot applications and absentee ballots if the county auditor determines the signature does not match the voter’s signature on file; and (3) require the inclusion of a voter verification number on applications for absentee ballots. The injunction also prohibits the secretary from including language on absentee ballot applications that a voter ID number is required, and from disseminating materials for the 2018 election informing voters that they will be required to present a form of valid identification when voting.
