Appellant appeals from a district court order denying her motion under Iowa Code section 901C.2(1)(a)(2017) to expunge the records of criminal charges brought against her in 2009 which were dismissed pursuant to a negotiated agreement. Appellant contends the district court erred in denying expungement based on her failure to repay the full amount of the attorney fees for her court-appointed counsel in the criminal case. Appellant argues that Iowa Code section 901C.2(1)(a)(2) violates the federal and state equal protection clauses in requiring repayment of court-appointed attorney fees as a prerequisite for expungement.
