Plaintiffs appeal, and defendants cross-appeal, from portions of a district court order granting a summary judgment in plaintiffs’ action for injunctive relief and damages arising from defendants’ decision not to submit to the county election commissioner plaintiffs’ ballot proposal regarding the demolition of a local elementary school. Plaintiffs contend the district court erred: (1) in dismissing their claims under 42 U.S.C. § 1983 and 42 U.S.C. § 1985 by finding their constitutional rights had not been violated; (2) in declining to award them damages and other relief; (3) in finding defendants were protected by qualified immunity; (4) in its ruling on a discovery issue; (5) in declining to award attorney fees; and (6) in declining to rule that a favorable vote on plaintiffs’ ballot proposal will preclude demolition of the school. Defendants contend the court erred: (1) in finding the school board exceeded its authority in determining that the referendum petition was not “authorized by law” pursuant to Iowa Code section 278.2(1)(2017); (2) in ruling that a private right of action exists to enforce Iowa Code section 278; and (3) in interpreting the term “disposition” of school property found in Iowa Code section 278.1(1)(b).
