Travis Carl Boyer appeals, and was granted a delayed appeal, of the district court order requiring him to pay a civil judgment for room and board reimbursement. He contends: (1) the order for reimbursement of jail fees is a restitution order in a criminal case, and the trial court erred by ordering him to pay room and board for time spent in jail without finding that he had the reasonable ability to pay; and (2) because the statute allows the sheriff to impose a judgment as a civil matter in a criminal case without the opportunity to be heard, it violates due process and is thus, unconstitutional.
