Case No. 18-1985

Jesus Lozano Campuzano
v.
Iowa District Court for Polk County

Jesus Lozano Campuzano (Campuzano) sought correction of his sentence for possession of a controlled substance with intent to delivery, a class B felony, with a firearm enhancement, in violation of Iowa Code sections 124.401(1)(b)(7) and 124.401(1)(e). Campuzano argued that legislation enacted in 2016 reducing mandatory minimum sentences for defendants serving sentences under section 124.401(1)(b) should be applied to him. The district court denied the motion, finding that offenders sentenced under the firearm enhancement in section 124.401(1)(e) are not eligible for the reduction in sentence. The supreme court granted Campuzano’s petition for writ of certiorari.
