Plaintiff, the publisher of two newspapers in O’Brien County, appeals a district court order affirming the board of supervisors’ designation of two newspapers owned by intervenor as the official county newspapers for publication of official proceedings. See Iowa Code ch. 349 (2019). Plaintiff contends the court erred in not treating plaintiff’s two newspapers as one newspaper, and intervenor’s two newspapers as one newspaper, pursuant to Iowa Code section 349.6 for purposes of determining which papers had the largest number of subscribers. Plaintiff also contends the court erred by failing to find intervenor’s affidavit of bona fide yearly subscribers did not comply with statutory requirements.
