The supreme court granted Chance Beres’ application for interlocutory appeal seeking review of the district court’s denial of his motion to dismiss four counts of arson. He argues the State breached the plea agreement in a prior prosecution that prohibited the State from filing additional charges upon his cooperation with an interview regarding prior incidents of arson, and the State never sought an interview. He therefore maintains the court erred in failing to dismiss the new charges.
