Mercedes JoJean Damme appeals following her guilty plea for two counts of third-degree theft in violation of Iowa Code section 714.3. Final judgment and sentence was entered on July 1, 2019. Damme argues: (1) the district court erred and abused its discretion in considering improper factors when sentencing her; (2) the district court erred by not advising Damme of her right to file a motion in arrest of judgment; and (3) counsel was ineffective by breaching essential duties that caused Damme prejudice. The State contends the court lacks jurisdiction to consider this guilty plea appeal and her ineffective assistance of counsel claims pursuant to Senate File 589.
