State of Iowa
v.
Howard J. Thompson
Howard Thompson appeals from a guilty verdict on two counts of attempting to obtain a prescription drug by deceit and one count of conspiracy to commit a non-forcible felony. Thompson argues the district court erred when it allowed the State to use evidence from court documents that was without foundation and irrelevant to prove he acted with fraudulent knowledge and intent. He further argues that Iowa Code section 814.6A (2019) impairs the court’s constitutional duty to secure justice for appellate litigants and violates the Iowa Constitution’s separation of powers clause.
