David Treptow appeals following his guilty pleas to the charges of possession of a controlled substance with intent to deliver, failure to affix a drug tax stamp, and gatherings where controlled substance are used enhanced as a second or subsequent offense. Treptow argues Iowa Code sections 814.6(1)(a)(3), 814.7, and 814.29 must be invalidated for improperly restricting the role and jurisdiction of Iowa’s appellate courts. He further contends Iowa Code sections 814.6(1)(a)(3) and 814.7 violate equal protection, due process, and the right to effective counsel on appeal. If section 814.6(1)(a)(3) applies, Treptow contends he has good cause to appeal as the minutes of testimony do not establish a factual basis for his Alford plea to gatherings where controlled substance are used.
