Plaintiff in negligence action seeking recovery for injuries sustained from a fall on an icy walkway in front of defendant’s apartment complex appeals from a summary judgment dismissing her claims on grounds the continuing storm doctrine precluded liability. Plaintiff contends the district court erred: (1) by failing to recognize the continuing storm doctrine should be abandoned following the supreme court’s adoption of the Restatement (Third) of Torts in Thompson v. Kaczinski, 774 N.W.2d 829 (Iowa 2009); (2) in finding the continuing storm doctrine was even applicable under the facts of this case; and (3) by failing to find genuine issues of fact prevented summary judgment on the issue.
