Kristina Lewis was injured in a fire at the apartment she leased from Javier Escobar Flores and Benito Rodrigues dela Rosa (together, “Flores”). At the time of the fire, Flores was purchasing the property on contract from Howard L. Allen Investments, Inc. (“HLAII”). Lewis brought suit against Flores, HLAII, Howard L. Allen, and several other corporate entities owned by or affiliated with HLAII or Allen. She alleged HLAII and Allen were liable for her injuries for failing to properly maintain the apartment because they retained “legal title” to the property as contract sellers, and were therefore owners and landlords of the property pursuant to the Uniform Residential Landlord and Tenant Act (URLTA). Lewis appeals from the district court’s denial of her partial motion for summary judgment against HLAII and Allen and the court’s grant of summary judgment in favor of HLAII and Allen rejecting that argument.
