The Iowa Association of Business and Industry (ABI) appeals from the district court’s order denying its motion for summary judgment and granting the motion for summary judgment filed by the City of Waterloo, the Waterloo Commission on Human Rights, and Martin M. Peterson. ABI argues the court erred when it failed to find Waterloo Ordinance 5522, which regulates the use of criminal history background checks with respect to employment applications and hiring decisions, improperly regulates “hiring practices . . . or other terms and conditions of employment,” and is contrary to federal and state law, in violation of home-rule authority as provided in Iowa Code section 364.3(12).
