Plaintiff James Larew appeals and defendant Hope Law Firm, P.L.C., cross-appeals from the district court’s ruling in a breach-of-contract action. The district court found Hope Law Firm was liable to Larew under a theory of implied-in-fact contract and awarded quantum meruit damages in the amount of $261,640.39, plus interest. The court dismissed Larew’s remaining claims and the defendants’ counterclaims. Larew argues the district court: 1) erred in finding that Hope Law Firm & Associates, P.C., was not a successor to Hope Law Firm, P.L.C.; 2) failed to determine terms of the implied contract and when it was breached; 3) improperly calculated the quantum meruit owed; 4) erred in failing to affirm evidence of conversion and conspiracy; 5) erred in not holding defendants Andrew Hope and Travis Burk individually liable; and 6) erred in not awarding punitive damages. Hope Law Firm argues the district court erred in failing to apply the terms of compensation provided for in the “of counsel” arrangement. If quantum meruit applies, Hope Law Firm argues the district court improperly calculated the quantum meruit owed. Hope Law Firm further argues the district court erred in failing to enter judgment against Larew on its claim of interference with contract.
