The supreme court granted J.D. Anderson’s petition for writ of certiorari following the district court’s denial of his motion to correct an illegal sentence. Mr. Anderson argues the court erred in applying the mandatory minimum and earned-time restrictions of sections 902.13 and 903A.2(1)(b)(1) to his conviction for domestic abuse assault, third offense, in violation of Iowa Code section 708.2A(4), because he was not convicted for a third time of a third offense of domestic abuse (a so-called “third-third”).
