Pamela Middlekauff appeals from her conviction and sentence for possession of marijuana, first offense, in violation of Iowa Code section 124.401(5). Middlekauff argues the district court erred in denying her motion to dismiss as she has an Arizona medical marijuana card that constitutes proof of a valid prescription under Iowa law. If an Arizona medical marijuana card does not constitute proof of a valid prescription under Iowa law, Middlekauff argues section 124.401(5) is unconstitutionally vague. Middlekauff further argues she was denied a fair trial because the district court (1) refused to instruct the jury on her affirmative defense; (2) allowed the State to introduce testimony of a DCI criminalist without providing a minute of the witness’s testimony; (3) allowed the State to introduce the laboratory report; and (4) allowed the State to introduce the marijuana.
