Jeffrey Bittner appeals from the probate court’s order awarding fees to the attorneys representing U.S. Bank, N.A. in a declaratory judgment action regarding the disposition of funds in an IRA trust. He argues U.S. Bank violated its fiduciary duty by taking sides in a dispute over the identify of the beneficiary, and while knowing it had a conflict of interest. Specifically, he argues the probate court erred because U.S. Bank could not obtain reimbursement for fees after violating its duty of impartiality and acting contrary to the language of the IRA trust agreement.
