The City of Ames filed a petition for declaratory order with the Iowa Public Employment Relations Board (PERB) regarding the effect of amendments to Iowa Code chapter 20, enacted in 2017, specifically as they pertain to the bargaining rights of the City’s transit and non-transit workers. The City appeals from the district court’s order on judicial review affirming PERB’s order. It contends the court erred in affirming PERB’s findings Iowa Code section 20.32 applied to the City’s non-transit employees where federal funding was jeopardized and non-transit employees who are part of a bargaining unit with thirty percent or more transit employees are in a public safety unit with corresponding bargaining rights. Specifically, the City argues the court erred because: (1) the conditions precedent for the application of Iowa Code section 20.32 were not satisfied; and (2) it misapplied rules of statutory construction because a plain reading of section 20.32 show it applies only to transit employees.
