Jim Sutton and Angela Sutton

Jim and Angela Sutton filed suit against Council Bluffs Water Works (CBWW) raising claims of strict liability and negligence after their residence sustained settlement damages as a result of underground water main breaks. CBWW filed a motion to dismiss the strict liability claim arguing that such a claim is barred by the Iowa Municipal Tort Claims Act. The district court denied the motion to dismiss. CBWW was granted an interlocutory appeal of the district court’s ruling.
