State of Iowa
The State appeals and public employees’ union cross-appeals from a district court’s summary judgment ruling in Union’s action to enforce the collective bargaining agreement upheld in UE Local 893/IUP v. State, 928 N.W.2d 51 (Iowa 2019). The State contends the district court erred: (1) in finding the State breached the collective bargaining agreement when it stopped collecting dues; (2) by ordering the State to pay the dues as damages rather than ordering retroactive dues deductions; and (3) by concluding the union had adequately mitigated its damages. The Union contends the court erred in denying its request for attorney fees on its bad faith claim.
