The defendant was granted discretionary review of the district court’s victim restitution order entered after successful completion of a deferred judgment. The defendant argues the district court lacked subject matter jurisdiction and/or statutory authority to enter a restitution order for payment of the victim’s pecuniary damages after the successful completion of all conditions of the deferred judgment, dismissal and expungement. The defendant further argues the restitution order is not supported by substantial evidence.
