Defendant in suit alleging medical malpractice appeals from a district court judgment entered on a jury verdict awarding plaintiff $97 million in damages. Defendant seeks reversal of the judgment and remand for a new trial. Defendant contends: (1) the specifications of negligence submitted to the jury had no evidentiary support and used language favoring plaintiff; (2) evidence was erroneously admitted under the residual exception to the hearsay rule; (3) plaintiff’s counsel engaged in repeated and deliberate misconduct; (4) the verdict was flagrantly excessive; and (5) the high-low settlement entered between its co-defendant and plaintiff limits its liability to only 50% of the economic damages awarded by operation of Iowa Code chapter 668.
