Case No. 23-0482

David A. Vaudt and Jeanie K. Vaudt
v.
Wells Fargo Bank, N.A.

David and Jeanie Vaudt appeal from the district court’s dismissal of their actions for boundary by acquiescence and adverse possession. They argue the court erred by applying the one-year statute of limitations of Iowa Code section 614.14(5)(b) because their claims did not “arise out of” the transfer of the adjoining property by a trustee’s deed, pursuant to Heer v. Thola, 613 N.W.2d 658 (Iowa 2000), but rather were previously established by operation of law.
