Northern Natural Gas Company (NNG) appeals a jury verdict in favor of Mark Vagts, Joan Vagts, Andrew Vagts, and Vagts Dairy, LLC (Vagts) finding that NNG had created a nuisance on the Vagts’ dairy farm by creating stray voltage and awarding economic damages, intangible nuisance damages, and damages for personal inconvenience, annoyance and discomfort. NNG argues: (1) the district court erred in determining that the Vagts could submit a stand-alone nuisance claim without having to demonstrate that NNG was negligent; and (2) the district court erred in denying NNG’s request for remittitur.
