Defendants in medical malpractice action seek interlocutory review of a district court order denying their motion to dismiss. Defendants contend the court erred in finding plaintiffs’ certificate of merit affidavit substantially complies with Iowa Code section 147.140 where the expert did not sign the affidavit under oath or under penalty of perjury. Defendants alternatively contend the court erred in failing to limit plaintiffs’ action to the negligence theory set forth in the certificate of merit affidavit.
