Case No. 23-1928

Benjamin G. Trane
v.
State of Iowa

Benjamin G. Trane appeals the district court’s order granting partial relief on his postconviction relief application, finding he was entitled to a new trial on the jury instruction, but denying his other claims. He argues trial counsel was ineffective for failing to move to sever his criminal charges for child endangerment from the charges for sexual abuse and sexual exploitation. The State cross-appeals arguing that the district court erred in finding that counsel was ineffective for not objecting to jury instruction 31, which was the marshalling instruction for child endangerment.
