The district court denied appellant Andrew Porter’s motion to suppress the evidence discovered in the search of a backpack during law enforcement officers’ execution of a search warrant in which Mr. Porter was not named and at a house he does not own or live in. This court granted Mr. Porter’s application for discretionary review. He argues the district court erred by finding he lacked standing to challenge the search because he had abandoned the backpack by disclaiming ownership. Mr. Porter argues the evidence should also be suppressed because there are no valid exceptions to the warrant requirement.
