Worthwhile Wind, LLC

Worth County Board of Supervisors

The Board of Supervisors of Worth County (“Board”) appeals from a district court order granting a declaratory judgment that Worthwhile Wind, LLC (“Worthwhile”) had a vested interest in developing a wind energy generation project on numerous parcels of land under the ordinance in existence at the time the Board imposed a moratorium on wind energy development, and that the Board acted with an improper purpose in imposing the moratorium, enacting a new wind energy ordinance, or both. The Board argues the district court erred when it declared (1) Worthwhile had vested interests in the project under the pre-existing regulatory scheme, and (2) the Board’s moratorium, wind ordinance, or both, were entered into or enacted in bad faith.
