The State Public Defender was granted certiorari review after the district court denied the Davenport local public defender office’s motions to withdraw from several criminal cases pursuant to Iowa Code section 13B.9 based on a “temporary overload.” The district court would not grant the motions without an evidentiary hearing for the public defender to prove its temporary overload. The district court subsequently designated an attorney from the Davenport office to represent the indigent defendant in each case. The parties dispute the role of the district court when a local public defender returns a case due to a “temporary overload” under section 13B.9.
